Definition of the problem:Truog’s critique of the ”brain death” concept outlines inconsistencies well understood in the U.S. ethical debate, while he is one of the first to suggest returning to the traditional, coherent concept of death, thus breaking with the ”dead-donorrule.” The German transplantation law of 1996 endorses equating ”brain death” with death. A defeated draft, however, had acknowledged that irreversible total brain failure is a death-near state with a zero prognosis; organ harvesting, then, was to be allowed only in (...)

Unitary field theories and “SUPER-GUT” theories work with an universal continuum, the structured spacetime of R. Descartes, B. Spinoza, B. Riemann, and A. Einstein, or a (Machian (1–3) ) structured vacuum according the quantum theory of unitary fields (Dirac, (4,5) and Heisenberg (6–8) ). The atomistic aspect of the substantial world is represented by the fundamental constants which are invariant against “all transformations” and which “depend on nothings” (Planck (9–11) ). A satisfactory unitary theory has to involve these constants like (...)

Habermas, same-sex marriage and the problem of religion in public life.Darren R. Walhof - 2013 - Philosophy and Social Criticism 39 (3):225-242.
This article addresses the debate over religion in the public sphere by analysing the conception of ‘religion’ in the recent work of Habermas, who claims to mediate the divide between those who defend public appeals to religion without restriction and those who place limits on such appeals. I argue that Habermas’ translation requirement and his restriction on religious reasons in the institutional public sphere rest on a conception of religion as essentially apolitical in its origin. This conception, I argue, remains (...)

    What is the Human Being?Patrick R. Frierson - 2013 - Routledge.
Philosophers, anthropologists and biologists have long puzzled over the question of human nature. It is also a question that Kant thought about deeply and returned to in many of his writings. In this lucid and wide-ranging introduction to Kant’s philosophy of human nature - which is essential for understanding his thought as a whole - Patrick R. Frierson assesses Kant’s theories and examines his critics. He begins by explaining how Kant articulates three ways of addressing the question ‘what is the (...)

  31. Gadamer on the Event of Art, the Other, and a Gesture Toward a Gadamerian Approach to Free Jazz".Cynthia R. Nielsen - 2016 - Journal of Applied Hermeneutics (1).
Several prominent contemporary philosophers, including Jürgen Habermas, John Caputo, and Robert Bernasconi, have at times painted a somewhat negative picture of Gadamer as not only an uncritical traditionalist, but also as one whose philosophical project fails to appreciate difference. Against such claims, I argue that Gadamer’s reflections on art exhibit a genuine appreciation for alterity not unrelated to his hermeneutical approach to the other. Thus, by bringing Gadamer’s reflections on our experience of art into conversation with key aspects of his (...)

  34. Toward a New Feminist Liberalism: Okin, Rawls, and Habermas.Amy R. Baehr - 1996 - Hypatia 11 (1):49 - 66.
While Okin's feminist appropriation of Rawls's theory of justice requires that principles of justice be applied directly to the family, Rawls seems to require only that the family be minimally just. Rawls's recent proposal dulls the critical edge of liberalism by capitulating too much to those holding sexist doctrines. Okin's proposal, however, is insufficiently flexible. An alternative account of the relation of the political and the nonpolitical is offered by Jürgen Habermas.

The Situated but Directionless Self: The Postmetaphysical World of Benhabib's Discourse Ethics.Elizabeth R. Hepburn - 1997 - Journal of Applied Philosophy 14 (1):59-68.
Drawing on the work of Jurgen Habermas, Seyla Benhabib has developed a system of communicative or discourse ethics. Her approach is said to respect differences and to count context as important but she also claims that it is postmetaphysical. I dispute this claim on two grounds. First, I argue that any system of ethics must be grounded by metaphysical commitments. Second, I show that in using elements of both Kantian and Aristotelian theory, Benhabib has imported metaphysical underpinnings into her theory (...)

Revisiting Foucault's ‘Normative Confusions’: Surveying the Debate Since the Collège de France Lectures.Christopher R. Mayes - 2015 - Philosophy Compass 10 (12):841-855.
At once historical and philosophical, Michel Foucault used his genealogical method to expose the contingent conditions constituting the institutions, sciences and practices of the present. His analyses of the asylum, clinic, prison and sexuality revealed the historical, political and epistemological forces that make up certain types of subjects, sciences and sites of control. Although noting the originality of his work, a number of early critics questioned the normative framework of Foucault's method. Nancy Fraser argued that Foucault's genealogical method was ‘normatively (...)

Ethics and Cyber Warfare: The Quest for Responsible Security in the Age of Digital Warfare.George R. Lucas - 2016 - New York, US: Oxford University Press USA.
From North Korea's recent attacks on Sony to perpetual news reports of successful hackings and criminal theft, cyber conflict has emerged as a major topic of public concern. Yet even as attacks on military, civilian, and commercial targets have escalated, there is not yet a clear set of ethical guidelines that apply to cyber warfare. Indeed, like terrorism, cyber warfare is commonly believed to be a war without rules. Given the prevalence cyber warfare, developing a practical moral code for this (...)

English summary: Jurgen Habermas, master thinker of the German-speaking parts of the world, has advanced to become a much-quoted critic of the secularisation hypothesis over the past ten years. Purveyors of theological-political Sunday speeches and theological-academical discussions alike have tried to self-assuringly latch onto his talk of the lasting relevance of the Jewish-Christian tradition, the rescuing appropriation of religious contents and his call for a cooperative project of translation within post-secular society. Stephan R. Jutte, on the other hand, aims to (...)

The rapprochement between critical social theory and liberal political theory raises the question of whether Critical Theory remains adequately equipped to respond to contemporary global crises such as nationalism and ecological devastation. Recent Critical Theory---represented by the 2nd generation Frankfurt School writings of Jurgen Habermas and his U.S. reception---has neglected the original program of critical theory as an oppositional methodology oriented to liberation. This liberatory spirit has been replaced by an internal debate whose boundaries are set by current discourses within (...)

Meanings of terrorism.Geoffrey R. Skoll - 2006 - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 20 (2):107-127.
Terrorism is a notoriously plastic word, depending on user, audience, and political context. This paper focuses on shifts in its meanings since the early 1970s. As federal statutes made terrorism a criminal offense, common usage changed from a broad meaning to one that specified terrorism as a political crime. The argument is that the state shapes meaning and public discourse through law. Peircean semiotics and the semiotic philosophy of Russian linguist Vološinov provide a framework to explore relationships among politics, law, (...)
